Nondiscrimination Policy Statement

Bakersfield City School District programs, activities, and practices shall be free from unlawful discrimination, including discriminatory harassment, intimidation, and bullying based on actual or perceived characteristics of race or ethnicity, color, ancestry, nationality, national origin, ethnic group identifications, age, religion, marital or parental status, physical or mental disability, sex, sexual orientation, gender, gender identity, gender expression, or genetic information or any other characteristic identified in Education Code 200 or 220, Penal code 422.55, or Government Code 11135, or based on association with a person or group with one or more of these actual or perceived characteristics.

Uniform Complaint Procedures

Uniform complaint procedures are used to address any complaint alleging:

  • District violation of applicable state or federal law or regulations governing consolidated categorical aid programs, migrant education, preschool and early childhood education programs, child nutrition programs, and special education programs
  • Unlawful discrimination, including discriminatory harassment, intimidation, or bullying
  • District violation of the prohibition against requiring students to pay fees, deposits, or other charges for participation in educational activities
  • District noncompliance with the legal requirements pertaining to the Local Control Accountability Plan (LCAP)/Local Educational Agency Plan (LEAP)
  • Retaliation against a complainant or other participant in the complaint process
  • Failure to meet the requirements for the development and adoption of the school safety plan

Williams Complaint Procedures

A Williams complaint allows the public to file grievances regarding:

  • Insufficient instructional materials
  • Teacher vacancy or misassignment
  • Facilities conditions that pose an emergency or urgent threat to the health or safety of students or staff
  • A school restroom has not been cleaned, maintained, or kept open

Sexual Harassment Policy Statement

The Bakersfield City School District is committed to maintaining a safe workplace and learning environment that is free of sexual harassment and retaliation. The Board of Education prohibits sexual harassment of students, job applicants, employees, contractors, or any other individuals including but not limited to parents and vendors. The Board also prohibits retaliatory behavior or action against persons who complain, testify, assist or otherwise participate in investigations of complaints regarding sexual harassment. Sexual harassment may, in certain circumstances, be a violation of Title VII of the Civil Rights Act of 1964 as amended, and/or Title IX of the Education Amendments of 1972, as well as California law. All persons including applicants, employees, students and independent contractors are protected under this policy. Policy information is provided here:
